Protecting Your Rights in a New York Divorce

Contested Divorce

Because New York is a fault state, you must have a separation agreement or grounds for a divorce. At Rametta & Rametta, L.L.C., we aggressively defend our clients' rights in many divorce-related issues, including:

• Temporary orders: These orders provide clients with temporary solutions while their divorce is being finalized. Use and possession orders offer an individual exclusive use of the home or vehicle. Temporary support can be allocated while the final divorce is pending, while an order of temporary custody determines child custody pending the final order.
• Orders of protection: Our lawyers will represent the petitioner or the person contesting the order in domestic violence restraining orders.
• Property division: We represent clients and help them determine an equitable division of the marital property. Our experience provides us a solid basis for dealing with business valuations, stock valuations and the division of assets. We also handle qualified domestic relations orders (QDROs) both during the divorce and for clients who have been divorced for years. If you have been divorced for a while but see that property was omitted from the original order, we can help you, even if we did not represent you in your original divorce action.
• Divisions of liabilities: In our current economy, fairly dividing credit card and other liabilities issues is crucial. You may also have foreclosure concerns; our attorneys fight aggressively to protect their clients' financial interests.
• Child support: In New York, child support is determined by state-governed guidelines. We fight to ensure the child support orders adhere to the guidelines and that all relevant income is considered, which may include special income such as bonuses, rental incomes and overtime income. However, when it is appropriate for the situation, we are also willing to request the court deviate from the guidelines.
• Post-judgment modification: We represent clients who are seeking modification of their existing divorce, child support or maintenance order.
• Enforcement and contempt: If your ex-spouse is not abiding by the divorce order, child support or custody order, or maintenance order, we can represent you in enforcement actions, including actions for contempt.
